When manufacturers discover that they are distributing defective products that are either already in the market or are still in the distribution pipeline towards the consumer, they must take steps to stop distribution and to recover such products so that harm (or further harm) by defective products can be prevented. Both locally and internationally there have been countless instances where product defects affect large numbers of products and consumers. In such cases manufacturers have an obligation to prevent the further circulation of defective products, and they then often take steps to withdraw such products from further distribution. Defective products may also be recovered from consumers for repair or replacement.
The National Consumer Commission (NCC) has issued guidelines for the conduct of product recalls. These Guidelines apply when health or safety hazards in products are detected. The primary purpose of the Guidelines is to ensure that unsafe products are effectively removed from the marketplace. A supplier who commences a product recall must promptly notify the NCC of the recall.
