Care, Contact and Guardianship
These three elements together with maintenance play an extremely important role in the relationship between two parties when minor children are involved. These elements together with maintenance comprise what is referred to as Parental Responsibilities and Rights.
An unmarried father can now, in terms of the Children’s Act 38 of 2005, acquire full parental responsibilities and rights provided that he complies with the requirements.
Partners who are unmarried and who decide to separate should consider putting a Parenting Plan in place. A Parenting Plan will assist the parents of the child in clearly setting out exactly what is expected of each parent.
It is important to remember that the parents themselves formulate and agree on the appropriate Parenting Plan.
Mediation might be appropriate in some cases.
