Antenuptial Contracts
Most people know that if they don’t want to be married in community of property they need to sign some sort of a contract. A marriage that is not in community of property can be either out of community of property or out of community of property but subject to the “accrual regime”.
Such a contract is referred to as an antenuptial contract.
The parties to an antenuptial contract must remember that they should sign the contract before they get married. This is just as important to parties getting married in terms of the Recognition of Customary Marriages Act or just in terms of their specific culture.
The parties must further also remember that the antenuptial contract must be signed in front of a notary public, executed by the notary public and then registered in the Deeds Office before the antenuptial contract is enforceable against third parties.
